Terms of Service & Privacy Policy

This platform (hereinafter referred to as the “Platform”) provides users with services for uploading, browsing, and sharing entertainment-related images and related content (the “Service”).

By registering, logging in, or using the Service, users acknowledge that they have read, understood, and agreed to be bound by these Terms of Service (the “Terms”) and any related policies.

The Platform reserves the right to modify these Terms at any time for operational or legal reasons. Continued use of the Service after such modifications constitutes acceptance of the revised Terms.

1. Eligibility

1.1 The Service is available only to individuals who are at least eighteen (18) years of age and possess full legal capacity.

1.2 Users represent and warrant that all information provided is true, accurate, and complete. Any false information shall be the sole responsibility of the user.

1.3 The Platform reserves the right to terminate accounts and remove data if a user is found to be ineligible.

2. Account Management and Security

2.1 Users shall provide a valid and reachable email address and ensure that such information remains accurate and accessible.

2.2 Users are responsible for safeguarding their account credentials and shall not transfer, lend, or share their accounts.

2.3 Any activity conducted through a valid login shall be deemed to have been performed by the account holder.

2.4 Users must immediately notify the Platform of any unauthorized use or security concerns.

2.5 The Platform shall not be liable for any loss or damage resulting from inaccurate or unreachable contact information provided by the user.

3. User Conduct and Content Policy

3.1 Users shall comply with all applicable laws and internet usage standards when using the Service.

3.2 Users shall not upload, publish, or distribute any content that violates laws or infringes upon the rights of others, including but not limited to:

(a) Violations of rights of publicity, privacy, reputation, or personality rights
(b) Violations of personal data protection laws
(c) Infringement of intellectual property rights
(d) Content constituting defamation, obscenity, or other criminal offenses

3.3 Users shall not engage in the following activities:

(a) Using artificial intelligence technologies (including but not limited to face-swapping or deepfake technologies) to create or manipulate content involving another person’s likeness in sexual, nude, or otherwise rights-infringing contexts
(b) Creating or distributing content that harms another person’s reputation, privacy, or mental well-being
(c) Using another person’s image or personal data without consent

3.4 Users represent and warrant that:

(a) All uploaded content is lawful and does not infringe any third-party rights
(b) They have the legal right to use and distribute such content
(c) The content does not involve unauthorized synthetic or manipulated representations

3.5 Users shall cooperate with the Platform in any investigation, dispute, or legal proceeding and provide necessary information upon request.

3.6 Users shall be fully liable for any damages caused by violations of these Terms and shall indemnify the Platform for all resulting losses, including legal fees and related costs.

4. Nature of the Platform and Legal Relationship

4.1 The Platform provides only technical services and storage space for user-generated content.

4.2 The Platform does not participate in the creation, editing, or prior review of user content and does not exercise substantive control over such content.

4.3 No partnership, agency, employment, or joint operation relationship exists between the Platform and users.

4.4 The Platform does not participate in any transactions, negotiations, or dispute resolution between users. All such matters are solely the responsibility of the users involved.

4.5 The Platform operates as a neutral technical intermediary and does not provide services that facilitate illegal transmission, distribution, or exchange of content.

4.6 Any disputes arising between users and third parties shall be resolved independently and shall not involve the Platform.

5. Content Moderation and Takedown Policy

5.1 The Platform, by virtue of its authority to manage and control content, assumes a reasonable duty to review and handle content in order to comply with applicable laws and protect third-party rights.

5.2 Upon receiving a report or where there is a reasonable basis to believe that content may infringe rights, the Platform shall review such content within a reasonable timeframe and may take appropriate actions, including:

(a) Removal or takedown of content
(b) Restriction of access
(c) Suspension or termination of accounts

5.3 Where content is manifestly unlawful or infringing, the Platform shall take prompt action to prevent further harm.

5.4 The Platform may request supporting documentation from users and may report to competent authorities when necessary.

5.5 Any actions taken by the Platform in compliance with legal obligations, protection of rights, or public interest shall not constitute a breach of contract or liability.

6. Reporting Mechanism

6.1 Any person may report content suspected of being illegal or infringing.

6.2 Reports may be submitted via:

6.3 The Platform will process reports in accordance with reasonable procedures.

6.4 The identity and personal data of reporters will be protected in accordance with applicable laws.

7. Limitation of Liability

7.1 The Platform has no obligation to conduct prior review of user-generated content.

7.2 However, upon obtaining knowledge or reasonable awareness of unlawful or infringing content, the Platform will take appropriate action in accordance with applicable laws.

7.3 The Platform makes no representations or warranties regarding the legality, accuracy, or completeness of user content.

7.4 Users are solely responsible for all legal consequences arising from their conduct or content.

7.5 To the fullest extent permitted by law, the Platform shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Service.

8. Data Collection, Logging, and Legal Compliance

8.1 The Platform may record user login information, IP addresses, activity logs, and related data for security, legal compliance, and user protection purposes.

8.2 Such data shall be retained for a reasonable period in accordance with applicable laws and internal policies.

8.3 The Platform may disclose such data to competent authorities when legally required.

8.4 Users consent to the collection, processing, and use of such data as necessary for the operation of the Service.

8.5 The Platform may collect the following types of personal data, including but not limited to:
(a) Email address
(b) Account-related information
(c) IP address
(d) Login timestamps and access records
(e) User activity and system logs

 

8.6 The purposes for collecting and processing personal data include:
(a) Providing and maintaining the Service
(b) Verifying user identity and ensuring account security
(c) Handling reports, disputes, and customer support requests
(d) Preventing fraud, abuse, or unlawful activities
(e) Complying with legal obligations or governmental requests

8.7 Personal data will only be used within the scope of the above purposes. The Platform does not sell, trade, or rent personal data to third parties.

 

8.8 Personal data will be retained for a reasonable and necessary period in accordance with legal requirements, dispute resolution needs, and operational purposes.

 

8.9 The Platform will not disclose personal data to third parties except in the following circumstances:
(a) When required by law or competent authorities
(b) When necessary to protect the legitimate rights and interests of the Platform or others
(c) With the user’s consent

 

8.10 Users may request access, correction, or deletion of their personal data in accordance with applicable laws. However, the Platform may refuse such requests where retention is required by law or necessary for legitimate purposes.

 

8.11 The Platform may use cookies or similar technologies to enhance user experience and perform analytics.

 

8.12 The Platform implements reasonable technical and organizational measures to protect personal data from unauthorized access, disclosure, or alteration.

9. Intellectual Property

9.1 Users retain ownership of the rights to their uploaded content.

9.2 Users grant the Platform a license to use, store, reproduce, and transmit such content as necessary to provide the Service.

10. Governing Law and Jurisdiction

10.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of China (Taiwan).

10.2 Any disputes arising from the Service shall be subject to the jurisdiction of the court at the location of the Platform as the court of first instance.

  本平台（以下稱「本平台」）係提供用戶上傳、瀏覽與分享娛樂性圖片及相關內容之服務（以下稱「本服務」）。

用戶於註冊、登入或使用本服務時，即表示已詳閱並同意遵守本條款及相關規範。

本平台得因營運或法律需求，隨時修訂本條款，用戶於修訂後繼續使用本服務者，視為同意修訂後之條款。

第一條 用戶資格

一、 本服務僅限年滿十八歲且具有完全行為能力之自然人使用。

二、 用戶應保證其提供之資料為真實、正確且完整，如有不實，應自負一切法律責任。

三、 本平台如發現用戶不符資格，得逕行終止帳號並刪除相關資料。

第二條 帳戶管理與安全

一、 用戶於使用本服務時，應提供有效之電子郵件地址，並確保該資訊可供聯絡。

二、 用戶應妥善保管帳號及密碼，不得轉讓、出借或與他人共用。

三、 凡經由正確帳號密碼登入所為之行為，均視為用戶本人之行為。

四、 如發生帳號遭盜用或有安全疑慮時，用戶應立即通知本平台，本平台得採取必要措施。

五、 用戶如提供不實或無法聯繫之聯絡資訊，致通知無法送達或產生任何損害者，應自行負責。

第三條 用戶行為與內容規範

一、 用戶於使用本服務時，應遵守中華民國相關法令及網際網路使用慣例。

二、 用戶不得上傳、發布或散布任何侵害他人權利或違反法令之內容，包括但不限於：
（一）侵害肖像權、隱私權、名譽權或人格權之內容
（二）違反個人資料保護法之內容
（三）侵害著作權、商標權或其他智慧財產權之內容
（四）涉及刑法妨害名譽、散布猥褻物或其他犯罪之內容

三、 用戶不得從事下列行為：
（一）利用人工智慧技術（包括但不限於AI換臉、深度合成技術（Deepfake）等），將他人肖像與裸露、性影像或其他侵害人格權之內容進行合成或變造
（二）製作或散布足以造成他人名譽受損、隱私侵害或精神損害之影像或資訊
（三）未經本人同意使用他人影像或個人資料

四、 用戶應聲明並保證：
（一）其上傳之內容均為合法，且未侵害任何第三人之權利
（二）其對所提供內容具有合法使用權限
（三）其內容未涉及未經授權之影像合成或人格權侵害行為

五、 用戶於涉及權利爭議、檢舉案件或法律程序時，應配合本平台之調查並提供必要之說明或資料。

六、 如用戶違反本條規定，致本平台或第三人受有損害，用戶應負一切法律責任，並應賠償本平台因此所受之全部損害（包括但不限於律師費、訴訟費用及其他相關支出）。

第四條 平台性質與法律關係

一、 本平台僅提供資訊儲存空間及技術服務，供用戶自行上傳、發布及瀏覽內容。

二、 本平台並未參與內容之製作、編輯或事前審查，亦未對用戶內容進行實質控制。

三、 本平台與用戶間，不成立任何合夥、代理、委任、僱傭或共同經營關係。

四、 本平台不參與用戶間之任何交易、磋商、履約或爭議處理，用戶間之法律關係應由用戶自行負責。

五、 本平台僅提供中立技術服務，並未提供任何促成違法內容傳輸、下載或交換之功能或服務。

六、 用戶如因使用本服務與第三人發生爭議，應自行解決，與本平台無涉。

第五條 內容管理、審查與下架機制

一、 本平台基於其對平台內容之管理及控制權限，為維護法令遵循及第三人權益，負有合理之審查及處理義務。

二、 本平台於接獲檢舉或依客觀情形合理判斷內容可能侵害他人權利時，應於合理期間內進行審查，並採取適當措施，包括但不限於：
（一）移除或下架內容
（二）限制存取
（三）暫停或終止帳號

三、 如內容依客觀情形顯然涉及違法或侵權，本平台應即時採取必要措施，以防止損害擴大。

四、 本平台得要求上傳者提供相關權利證明或說明，並得依情況通報主管機關或司法機關。

五、 本平台基於法令要求、權利保護或公共利益所為之處理行為，不構成對用戶之違約或侵權。

第六條 檢舉與通報機制

一、 任何人得就疑似違法或侵權內容向本平台提出檢舉。

二、 檢舉方式如下：

三、 本平台於接獲檢舉後，將依合理程序進行審查及處理。

四、 檢舉人之資料將依法保護，除法律要求外，不對外揭露。

第七條 責任限制

一、 本平台對於用戶所上傳或發布之內容，不負事前審查義務。

二、 然本平台於知悉或依合理判斷可得知內容涉及違法或侵權時，將依法採取必要措施。

三、 本平台對於用戶內容之真實性、合法性及完整性，不負任何明示或默示之保證。

四、 用戶因其行為或內容所生之一切法律責任，應由用戶自行負責。

五、 在法律允許之最大範圍內，本平台對於因本服務所生之間接、附帶或衍生性損害，不負賠償責任。

第八條 資料紀錄與法律配合

一、 本平台為維護服務安全、保障用戶權益及配合法律要求，得記錄用戶之登入資訊、IP位址、操作紀錄及相關使用資料。

二、 前述資料將依法律及本平台政策保存於合理期間內。

三、 於主管機關或司法機關依法要求時，本平台得提供相關資料，以協助調查或處理爭議。

四、 用戶同意本平台於必要範圍內蒐集、處理及利用前述資料。

五、 本平台蒐集之個人資料類型，包括但不限於：
（一）電子郵件地址
（二）帳戶相關資訊
（三）IP 位址
（四）登入時間及使用紀錄
（五）系統操作行為紀錄

六、 本平台蒐集及處理個人資料之目的如下：
（一）提供及維護本服務之正常運作
（二）確認使用者身分及帳戶安全
（三）處理檢舉、爭議及客服需求
（四）防止詐欺、不當使用或違法行為
（五）配合法令要求或主管機關之調查

七、 本平台僅於前述目的範圍內使用個人資料，並不會將個人資料出售、交換或出租予第三人。

八、 本平台將於合理且必要之期間內保存個人資料，保存期間將依據法令要求、爭議處理需求及平台營運目的而定。

第九條 智慧財產權

一、 用戶上傳內容之權利仍歸用戶或其合法權利人所有。

二、 用戶同意授權本平台於提供服務之必要範圍內，得對內容進行重製、儲存及公開傳輸。

第十條 準據法與管轄

一、 本條款之解釋與適用，以中華民國法律為準據法。

二、 因本服務所生之爭議，以本平台所在地之地方法院為第一審管轄法院。
