Terms of Service & Privacy Policy

This Platform provides users with services to upload, browse, and share entertainment-related images (hereinafter referred to as the "Service"). Please read the following terms (hereinafter referred to as the "Terms") carefully. By registering for, logging into, or using the Service, the user is deemed to have agreed to accept these Terms and all contents of related regulations or announcements established pursuant hereto. Furthermore, the Platform reserves the right to amend these Terms from time to time in accordance with operational and legal requirements. Continued use of the Service by the user following such amendments shall constitute the user's acceptance of the amended Terms.

I. User Eligibility

The use of this Platform is restricted solely to individuals who are at least 18 years of age and possess full legal capacity. The User represents and warrants that they have reached the age of 18. The User shall be solely liable for any legal consequences or liabilities arising from the provision of false or inaccurate information. In the event the Platform discovers that a User is a minor, the Platform reserves the right to immediately suspend the account, delete data, and refuse to provide the Service.

II. User Registration and Account Security

1. Registration and Data Integrity Users may be required to register an account when using the Platform. When registering, the User shall provide complete and accurate personal information and maintain such information to keep it up-to-date. In the event the User provides any information that is untrue, inaccurate, not current, or incomplete, or if the Platform has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, the Platform reserves the right to suspend or terminate the User's membership and refuse any and all current or future use of the Service (or any portion thereof).
2. Account Security and Liability The User shall properly safeguard and maintain the confidentiality of their account and password, and shall not transfer, lend, or share them with any third party. Any actions taken or activities conducted using the correct account and password shall be deemed as actions taken by the User personally. The User shall be held fully liable for all activities that occur under their account and password.
3. Notification of Security Breaches If the User becomes aware of any unauthorized use of their account or password, or any other security breach, the User must notify the Platform immediately. Upon receipt of such notice or upon otherwise verifying such unauthorized use, the Platform will suspend any payment transactions instructed by said account, suspend the acceptance of subsequent payment instructions from said account, and promptly notify the User.

III. User Conduct

1. Compliance with Laws When using the Service, the User shall comply with the relevant laws and regulations of the Republic of China and all international practices regarding internet use to avoid unnecessary legal disputes. If the User is located outside the Republic of China, the User also undertakes to comply with all laws and regulations of their respective jurisdiction.
2. Prohibition of Illegal Acts The User agrees and warrants not to use the Service to engage in any acts that infringe upon the rights of others or violate any laws. The User shall ensure that any content uploaded, posted, or shared does not violate relevant laws and regulations, including but not limited to:
   (1) The Child and Youth Sexual Exploitation Prevention Act
   (2) The Personal Data Protection Act
   (3) Portrait rights, copyrights, and other intellectual property rights
   (4) Offenses against reputation, forgery, fraud, and the dissemination of obscene materials under the Criminal Code
   (5) Other relevant laws and regulations of the Republic of China.
3. Privacy and Content Integrity The User shall not upload content that involves the privacy of others, unauthorized portraits, or infringes upon the rights of third parties in any manner. This includes, but is not limited to, capturing, altering, or synthesizing the facial or bodily images of others without their consent in any manner, or creating or disseminating content sufficient to cause damage to reputation, emotional distress, or infringement of privacy.
4. Violation and Enforcement In the event the Platform reasonably determines that the User has violated the aforementioned terms or engaged in conduct that poses a risk of harm to the Platform's interests, the Platform reserves the right to restrict part or all of the Service content, terminate or restrict access to the User's account, and remove any content associated with the User's account.

IV. Collection, Use, and Protection of Personal Data

1. Data Collection For the purpose of providing the Service, the Platform may collect necessary data, including but not limited to user account data, personal information, upload records, and login information.
2. Scope of Use The use of personal data shall be limited to the following purposes:
   (1) User services and account management
   (2) System security and service maintenance
   (3) Financial account processing
   (4) Necessary assistance as required by laws and regulations
   (5) Handling of reported incidents.
3. Data Protection and Disclosure The Platform shall properly store and protect user information in accordance with the Personal Data Protection Act. The Platform will not disclose such information to third parties without the User's consent, except where necessary to comply with legal requirements or to protect rights.
4. User Rights and Obligations The User has the right to choose whether to provide personal data and the obligation to provide accurate data. However, in the event the User elects not to provide such data, the User will be unable to use related functions or services of the Platform, nor will the User be able to participate in various activities provided by the Platform. Furthermore, the Platform will be unable to fulfill its relevant rights or obligations towards the User arising from such services or activities.

V. Content Management and Takedown Mechanisms

1. Right to Remove Content The Platform reserves the right to determine and remove content including, but not limited to, the following:
   (1) Content that violates laws, regulations, or these Terms
   (2) Content involving unauthorized portraits or personal data
   (3) Content reasonably suspected to be unlawful, infringing, or otherwise inappropriate.
2. Disciplinary Measures In the event of a violation by the User, the Platform may take the following measures depending on the severity of the circumstances:
   (1) Restriction of functions or suspension of use
   (2) Permanent suspension or termination of the account
   (3) Reporting or notifying competent authorities or judicial bodies where necessary.

VI. Reporting and Contact Mechanisms (System for Reporting Suspected Illegal Content)

1. Reporting Channels If the User discovers any content suspected of being unlawful, the User may notify or contact the Platform through the following channels:

2. Handling Procedures Upon receipt of a report, the Platform shall proceed in accordance with the following procedures:
   (1) Conduct a preliminary review of the content
   (2) Temporarily suspend access to or remove the images in question
   (3) Request the uploader to provide proof of rights or an explanation where necessary
   (4) Evaluate whether it is necessary to notify competent authorities or judicial bodies.
3. Protection of Reporters The personal data of the reporting party shall be protected in accordance with the Personal Data Protection Act. The Platform will not arbitrarily disclose or make such data public.

VII. Platform Disclaimer

1. No Pre-screening or Warranty The Platform solely provides a service for Users to upload and share content on their own initiative and does not provide any mechanism to pre-screen or review such content. The Platform assumes no responsibility for any content uploaded or published by Users and makes no warranties regarding the authenticity, legality, or completeness of such content.
2. User Responsibility The User shall bear full responsibility for all content they provide. Any damages, disputes with third parties, or legal liabilities arising from the User's use of the Platform shall be borne solely by the User.
3. Service Interruption The Platform reserves the right to suspend or discontinue the Service due to system maintenance, information security concerns, legal requirements, or force majeure events, without being liable for any compensation.
4. Limitation of Liability The Platform cannot predict when issues may arise with the Service. Accordingly, the Platform's liability shall be limited to the maximum extent permitted by applicable law. To the maximum extent permitted by applicable law, under no circumstances shall the Platform be liable for any loss of profits, revenue, information, or data incurred by the User, nor for any consequential, special, indirect, punitive, exemplary, or incidental damages arising out of or related to the Service, regardless of the cause of action or theory of liability (including negligence), even if the Platform has been advised of the possibility of such damages.

VIII. Intellectual Property Rights

1. Ownership of Content The copyrights and relevant rights in the content uploaded by the User shall remain the property of the User or their legitimate rights holders.
2. License to the Platform The User authorizes the Platform to perform necessary reproduction, storage, public transmission, or technical processing within a reasonable scope for the purpose of providing the Service.

IX. Governing Law and Dispute Resolution

1. Governing Law The interpretation and application of these Terms shall be governed by the laws of the Republic of China (Taiwan).
2. Jurisdiction Any disputes arising from the use of the Service shall be subject to the jurisdiction of the court where the Platform operator is located as the court of first instance.
